Welcome to Midlife Magnifique (the “Site”). These Store Terms & Conditions (“Terms”) govern your purchase and use of our products (digital and physical) and ALL services offered via www.midlifemagnifique.com (the “Store” and the "Website Pages").

By placing an order, you agree to these Terms.

1) Products & Services

We offer physical and digital products, including books/ebooks, downloads, courses, memberships, and other resources (collectively, “Products”).

Product descriptions, inclusions, and access details are shown on the relevant Product page at the time of purchase.

2) Pricing, Currency & GST

All prices are in AUD and include GST where applicable.

We may change prices at any time prior to your purchase.

Promotions and discount codes cannot be applied retrospectively.

3) Orders & Payment

By submitting an order, you warrant you are over 18 and authorised to use the selected payment method.

We accept the payment methods shown at checkout. Your order is accepted when we send an order confirmation.

If your payment is declined or later charged back, we may cancel access to Products until payment is resolved.

4) Delivery & Access

Digital Products:

Delivery is by download link and/or instant account access after payment. Access instructions are provided by email and on the website pages during checkout—please check spam/junk folders if you haven't received the required emails within 1 to 4 hours or purchase.

Physical Products (if applicable):

We pack and ship to the address you provide, so ensure all of your details are correct at time of order, as we are not responsible for deliveries going to incorrrect address if you get it wrong. Title and risk in goods pass on delivery. Shipping times are estimates only and dependant on your location to our warehouse.

5) Digital Products – Licence & Use

Upon purchase, we grant you a non-exclusive, non-transferable, personal licence to use the digital Product for your own non-commercial purposes.

You must not share, resell, upload, distribute, or make the Product available to third parties at any time or in any way.

You are responsible for ensuring your device and software can open the file types we provide.

We list common formats on the Product page and description.

6) Courses, Programs & Memberships

Access: Course and membership access details are described on the Product page (e.g., start date, duration, modules, downloads, community access).

Recurring Subscriptions: If a Product is subscription-based, you authorise recurring billing until you cancel.

Cancellation: You may cancel any time via your account or by contacting us at [[email protected]].

Cancellation stops future renewals. We do not pro-rate partial periods once a billing cycle has started.

Fair Use: We may suspend or terminate access if we detect misuse (e.g., sharing logins, files/content or abuse to MM staff or other MM Members).

7) NO REFUNDS POLICY (Change of Mind)

We want you to love what you buy for MM—so please read Product descriptions carefully before purchasing.

Digital Products (including digital downloads, ebooks, templates, audio/video files, and access to courses/memberships/directory etc.):

Because digital content is delivered immediately and cannot be “returned,” we do not offer refunds for change of mind, mistaken purchase, or if you did not download within the access window, to the maximum extent permitted by law.

Physical Products (sold via our third party production suppliers):

We do not offer refunds or exchanges for change of mind or incorrect selection. Please choose carefully and check sizing/specs on the Product page.

Important: Your rights under Australian Consumer Law (ACL)

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

If a Product is faulty, not of acceptable quality, or does not match its description, you may be entitled to a repair, replacement, or refund, depending on the nature of the problem.

8) Faults, Access Issues & Support

If you experience a technical issue (e.g., download link not working, corrupted file, access problem), email [[email protected]] within a reasonable time, and we’ll provide a fresh link or alternate delivery method.

For course, membership or directory access issues, we’ll verify your purchase and restore access promptly if the problem is on our side.

9) Pre-Orders & Backorders

Pre-order/Backorder delivery dates are estimates and may change.

We’ll keep you informed by email if timelines shift materially.

10) Gift Cards, Coupons & Credits

Gift cards and store credits are not redeemable for cash, non-transferable to another party, and are valid until their stated expiry.

One coupon code ONLY per order is permitted.

Coupons cannot be applied to ANY past purchases or current membership subscriptions etc.

11) Chargebacks & Disputes

If you have a concern, please contact us first at [[email protected]]—we’ll work with you to resolve it quickly.

Unwarranted chargebacks may result in account suspension.

12) Intellectual Property

All site content and Products (including text, images, graphics, video, audio, templates, and downloads) are protected by copyright and other IP laws.

You must not copy, reproduce, republish, share, or create derivative works without our prior written consent, except as expressly permitted by the licence in Section 5.

13) User Conduct & Community Spaces

Be kind and respectful to others.

We reserve the right to moderate or remove posts, comments, or materials in our communities or courses that are harassing, unlawful, or off-topic, or that violate these Terms or others’ rights.

14) Third-Party Tools & Links

We may use third-party platforms to produce and deliver our Digital and Physical Products (e.g., course hosting, payment processing).

Your use of those services may be subject to their own terms and privacy policies.

15) Privacy

We handle personal information in accordance with our Privacy Policy, available on the Site.

By purchasing, you consent to us using your details to fulfil your order and communicate about your purchase.

16) Warranties, Liability & Indemnity

Except as required by the ACL, we provide Products “as is” and make no warranty that they will meet your specific objectives or deliver particular outcomes.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, savings, data, or business opportunity.

Where liability cannot be excluded under the ACL, it is limited, at our option, to re-supplying the relevant Product or refunding the amount paid.

You agree to indemnify us for losses arising from your misuse of the Products or breach of these Terms.

17) Governing Law

These Terms are governed by the laws of Queensland, Australia.

You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

18) Changes to These Terms

We may update these Trading Terms and Conditions from time to time.

Changes apply to purchases made after the updated effective date.

The latest version will always be available on this Site.
